
Terms and Conditions
ACCEPTANCE
By purchasing any of the services offered or signing off on a brief you agree to the following terms and conditions.
TERMINATION
Termination of services by the Client must be requested in a written notice and will be effective on acceptance of such notice. The Client will be invoiced for any work completed to the date of first notice of termination. In the case termination is initiated by the Client before any deposit is in our account, but after any contract is signed or quote accepted, SH Design reserves the right to demand payment of the full deposit immediately.

SUSPENSION OF SERVICES
SH Design reserves the right to suspend all or any of the services that have been given to you, including those that have been already paid for should any of these terms not be met.
CHARGES AND PAYMENTS
The prices will be stated on the brief and invoice. Work will not be handed over until full payment is made, with the exception of Social Media Management, which is to be paid within 30 days of the invoice date. Social Media Management will be charged at a rate of £40 an hour, number of hours provided to be decided at the point of contract.
You can and may request additional services at any time after your Agreement has started. If I agree to provide you with these services you will pay the additional charges they incur. SH Design will charge you for any administration costs and/or loss of work that have occurred for any payment not being met for whatever reason. The charge for non-payment is a minimum of £40 on top of the original agreed upon price.
REFUND POLICY
All services are rendered ensuring quality and that they fit the agreed upon brief. If at any time you are not satisfied with the quality of work, you may bring it to my attention and make revisions where appropriate. However in general, refunds will not be processed. This is due to pricing being based on hours spent on a service as well as all services being designed to meet the agreed upon brief. Although if for any reason SH Design is unable to complete the work a refund will be issued.
All deposits are non-refundable unless I am unable to provide the agreed upon service.
COPYRIGHT
SH Design will source stock images for the Client however the purchasing and licencing of resources is the responsibility of the Client.
The Client retains the copyright to data, files and artwork provided by the Client, and grants SH Design the rights to publish and use such material. Unless explicitly specified in writing, it is assumed that:
SH Design will hold all copyright to websites, graphic and logo designs and grant the Client the rights to publish and use such material; It will remain the sole intellectual property of SH Design; SH Design will own the intellectual property rights in any service given to you. You have no resell rights, unless specifically granted to you in writing.
Delivery Times
Work will not begin until:

The deposit has been received

The brief has been signed off

All relevant materials and resources have been sent over
Until these have been received the countdown for agreed upon delivery times will not start. If any of these are received after 2pm work and the countdown, will begin the next working day
All delivery times are in working days
Availability of express options are subject to current workload
If you require me to work over a weekend this will be subject to a fee of £80 in addition to the originally agreed upon price.
GENERAL
These Terms and Conditions supersede all previous representations, understandings or agreements. To maintain the quality of our service to our clients I reserve the right to change these Terms and Conditions and the nature of our services at any given time.
WEBSITE DESIGN
You are not permitted to use a design for more than one website without prior written Agreement between you and SH Design. You agree that resale or distribution of the completed files is forbidden unless prior written agreement is made.
Websites will not be transferred until full payment has been received.
The cost of hosting the site is the responsibility of the Client, however I am happy to take you through the different options
Domain costs are also the responsibility of the Client however I am happy to source different options for you.
After completion of the site and once the balance has been paid, you or a third party of your choice may wish to edit your website to make updates and changes. However, you agree that in so doing you assume full responsibility for any issues which occur as a result.
For a £60 fee I will take you through the basics of using Wix so you can update your site after the initial design in completed.
PAYMENT TERMS
Payment is to be made in two instalments unless stated otherwise. SH Design takes 30% of the total fee upfront as a non-refundable deposit, and the remaining 70% balance before the site is set live and transferred. No work will be undertaken until the deposit is in my account. Updates will be provided at the agreed upon milestones. These updates are an opportunity for you to make any changes to the design if necessary.
2 revisions are provided as standard, however more can be purchased
Any revisions that change the design completely and/or move away from the original brief will be charged at a rate of £30 an hour, in addition to the original agreed price.
Revisions are classified as small changes requested within a single revision session. Any changes that are requested 24 hours after the first requests are made are classed as a new revision.
Any non-payment of an invoice is subject to a £40 administration charge. If you do not provide the requested/relevant information and resources needed to complete the design within 60 days of the initial order, the contract will be deemed complete. In such an event, all outstanding payments shall be paid immediately.
GRAPHIC DESIGN
INTELLECTUAL PROPERTY
Copyright of the completed designs, images, or other material created by the Company and any other Intellectual properties belong to SH Design unless agreed otherwise in writing.
Use of the designs are restricted to a single company of yours. You are not permitted to use a design for more than one product/service without prior written agreement. You agree that resale or distribution of the completed files is forbidden unless previously agreed otherwise in writing.
